H4 Visa (Advance Parole)

Hi Gurus,

Please advice me what I have to do in this situation..
I applied for my EAD/AP/I140/485 Concurrently in 2003 december and all of them are still pending.

Meanwhile I went to India for an emergency and I applied Emergency Advance Parole at my local ins office they issued me EAP, I went to india and got married came back to US using my Emergency Advance Parole.

Now My wife has to apply H4 visa (chennai) and I don't have valid H1 stamp in my passport and previous stamp got expired in 2003 August.But I have my next H1 (I797) approved form with me.

So GURUS Please advice me is it ok , If i send my 797 , LCA , I129 forms to my wife any apply for H4 visa , as i see in chennai website they didn't mention they require valid H1 visa ... to apply H4?

Using Advance parole will create any problems in issuing H4 visa???

That should not be a problem. But I wonder why didn't you get H1b stamped when you visited India?

Just for safe side, send your passport for revalidation to DC, in case consulate asks for stamped visa(very low likelyhood though).

Thank you very much for your respone , my wife has appointment on may 13th. so I don't have enough time to send it DC now.

But if it's required I will go to canda and get my H1 stamp.
