H4 transfer case-URGENT

Hi .
I am stuck with a problem.
I got laid off from work on sept 30,2002 but the employer gave me a unpaid leave for 30 days beginning oct 1.

Now i want to change my wife's status to F1 and was wondering if INS will ask for for any additional documents through the proces.

1.should i attach the unpaid leave letter along the change of status application
2.should i change my status to F1
3.am i now out of status
4.how long do i have to transafer my H1B

Please help as i have heard that this ite is very helpful and advice will be very beneficial.

Yes you are out of status, however change of H4 to F1 should not be a problem.
You should do the H1 transfer ASAP, INS has approved h1 transfers even after 90 days after being laid off, but generally requires you to go out of US to get a new I94.
