H4 to TN

Hi everyone!!!

Does anyone know how long does is the processing time of a H4 to a TN Visa??? Since my H4 expires on Jan 2009. Do I need to leave the country?

Also, I had before a H1B (used only my first 3yrs) wich visa would it be better to apply (or faster) TN or a H1B.

Last but not least.... after I send my petition what is the soonest that I can start working?

First, off, your H4 expiry shouldn't really concern you too much. Your spouse has to be on H1, so either he will get renewed (in which case his firm or you can easily renew your h4) or his H1 is ending, in which case your H4 ends at the same time. What is the situation with your H1 spouse?

As to getting TN, it is no more hard or easy than anyone else getting their first TN. You go to the border with a TN letter from your potential employer along with your credentials and $50, assuming you are cdn. Simple, and can be done tomorrow. You coould also mail-in an I-129 and wait for approval.

You are entitled to 3 more years in H1 and can begin almost immediatey; you need to finds someone willing to sponsor you and pay for the petition fee, and you can start as soon as you submit the I-129.


So to sum up:
1. TN at border, as soon as you get offer.
2. H1 by mail, as sson as you submit the I-129 and employer pays fee.
3. TN by mail, 2 weeks if premium processing, 3 months if plain.

My choice: Go to border and get TN, and then switch to H1 if and only if you go for GC.
