I would really appreciate in this regards. My wife is on H4 and is completing her 6th year next month. I am on H1, and, on 8th year extension. Can we file for her H1B now. Please help.
No body can stop you to apply after paying all the fees!!!.
But INS not going to approve her H1 after 6 yrs in H4 with no LC pending on her own. (Fees are not refundable)
