H4 to H1B COS, din't receive approval docs!

Hi,

I received my H1B approval on Jan 3rd 2011, after responding to an RFE. I was on H4 visa earlier.

My employer has not received the approval yet, whereas, USCIS website says, that the approval notice was mailed on 3rd Jan, 2011. My employer is about to apply for I 824 in a few days.

Since I was on H4 earlier, I don't have an SSN. And I can not apply for one until I receive the approval notice.

My concern is that, payroll systems can handle to run payroll without SSN only for upto 90 days, and if I-824 processing takes about a minimum 3 months, I will be without an SSN for a minimum of 4 months (30 days wait time before applying I-824, and 90 days after applying).

Can someone please tell me, how my H1B status can be maintained if I have to apply for I-824?

------------------------How did you "received my H1B approval on Jan 3rd 2011"??? Employer or lawyer who filed H1 gets the H1 approval from USCIS. if you have received H1 approval notice with I-94 attached then that is enough to get SSN.

------USCIS online status is not always correct. did the employer moved office after filing H1? did the lawyer filed H4 to H1 COS ?

Hi Ginnu,

When I said, "I received my H1B approval", i meant, I saw my status on USCIS website. I have not yet received the documents in hard copy...!
Unfortunately, there was no lawyer involved when my employer filled my H1B petition, but he hired a lawyer when I got an RFE.
And NO, my employer dint relocate after applying for my visa...!

Thanks for the advice though...!
