H4 to H1B before person enters USA-URGENT plz

I got married last month and my wife is in India got H4 visa otherday and intend to join me in few days. Now she want to beat H1B visa quota outage. So she like to apply immdiately for H1B visa and and few consulting companies agreed to do premium processing once she enters USA, coz we need her new I-94.

Question is?

"IS THERE A minimum 60 days wait period before we can apply for her H1 from h4?".

SOME ONE GAVE the logical reason that INS will never approve any work visa (status change from h4 to H1) as they see this intentional method to enter US. IS THIS TRUE.

You cannot beat Y2005 quota

She has to wait until Apr 2005 befor she apply H1b under Y2006 quota

NO

Do not listen logic. Always H4 to H1 allowed provided candidate must have to qualify INS requirementsThanks for ur help.
