H4 to H1

I've been on a H4 status for almost 4 yrs now and am about to file for divorce due to domestic violence. My question is would i have any problems should i file for a H1- would being on a H4 for 4 yrs affect the application?

I would appreciate any feedback. Thanks.
 
Except you will only be able to get an H-1 for 2 more years since you have already been in the US in H-4 status for 4 years.
 
Don’t you think if you file for divorce before your H1 is approved you will have no status as H4? as you would have taken divorce and after divorce you no more will be on H4 because your H4 is linked with your spouse H1?It will be better if you file for H1 while you are on valid H4 status and once you get your H1b approved then file for divorce
Consult a good lawyer before filing divorce or H1 and follow the advice of good lawyer to be in status
