Hello
I have a valid H4 visa(Dependent) and my company has applied for a fresh H1B in the month of february 2002 in texas center. so far i have not got my H1B approval papers. Presently i live in India .Is it possible to go to the USA with my valid H4 visa and once my H1B is approved can i get it stamped in USA with out coming to India. Will there be any risk if i come to USA on H4 and please clarify whether this is a good idea. My concern is i don't want to wait in India indefinetly for my H1B approval. please suggest any other options...

U can come to US in a current valid visa. Most probably the H1 is lined up for a consular notification (i.e applied as a new h1, instead of h4 to h1).

Either you can go back to India after getting h1 approval and get your h1 stamp to start working
Or you can apply for a fresh change of status from h4 to h1 after coming to US.

U cannot get it stamped in US in both cases. U have to go to a US consulate to get stamping. US consulates in canada or mexico have refused stamping for non US degree holders..
