Hi,
I am currently on H4. I had couple of question regarding H1b Filing . I recently came across a company that was willing to file my H1b. I wanted to know if there is any restriction , that we have to be direct employees of a company or client for whom we are working. I recetly herd that there have been couple of h1 stamping rejections in india if the h1 holder is working as a contracter for a company through multiple vendors in between for eg : H1b is with comapnyA (ie payrol is through cmapany A)and you are subcontarcting for a client but there are multiple vendors in between. If one is working like that will there be an issue if we go for visa stamping in india even if u have ur w2 and paystubs and all necessary legal documents.

---------------------First make sure US employer who is filing H1 for you has real job for you.also make sure that he is going to pay you once your H1 gets approved and dont keep on Bench. make sure employer has not violated H1 rule/regulations in past and past employers has not filed complaint against him to recover the wages through DOL. Dont pay to employer for H1. If employer is Desi company dont go for H1. If employer belongs to South India stay away from him.
