H4 to H1

Hi
I’m in U.S. on H-4 status for last 5 years. I entered in US on July 2001 and went to India 3 times and altogether stayed there for 11 months. Now I got an employer who is ready to sponsor my H1.So:
1. If I get my H1 approved, can my current stay in US affect it? Will I get my H1 for 6 years? Or it’ll be for only 1 year as I’m already in USA since last 5 years?
2. If my H1 gets rejected, will my H4 still be valid? Or I have to apply for my H4 again?
3. My husband applied for his labor in 2002. Can my change of status affect any way to get my EAD/Green Card in future?

1. You have 1 year and 11 months to go with H1, however, your h1 will start in 10/1/2006, and if you'll stay til 10/1/2006 as H4, practically you have 1 year and 3 months left for H1.
2. If it's just rejected, you are still on H4.
