H4 to H1 while applying H1 from India

Hi,

I have sent all my papers in order to file for H1B 2008 FY. So, soon after the cap opens, my petitioner would be filing my papers at INS.My husband has recently got his H1 stamped and is travelling to US in the mid of next month. I would like to accompany him on H4.
I doubt if I can travel with him on H4 and get my visa status changed and start working right away once my H1 gets approved. Or is it that I need to get my passport stamped with valid H1 either in India, Canada or Mexico???

It would be great if you can clear this query asap.
 
If you have I 94 at the time of applying your H1 then you can start working with your approved H1.

Your case you do not have I 94 at the time of apllying your H1, so you have to go out of US to get H1 visa stamped before start working with your sponser.
