H4 to H1 visa transfer & duration
Hi,
I am currently in H4 and looking to apply H1.Here is my situation please someone guide me.
I came in April 2000 to the country by H1B visa and was here till dec 2002 and then went back to India and worked there for 15 months and came back to USA by H4 visa( wife in H1).
Now planning to apply for H1, since my wife GC process is a long wait. How will be my visa status change considered, is that I need to wait till october to get H4 to H1 transfer??.will I lie under new H1 visa quota category?.
Also my H4 expires on April 2006, if I apply for H1 I will get it till April 2006. am I right??.( since I was in India for 15 months will it be considered and will they give visa expiry date as april 2006 + 15 months??)
