Hi
My wife came to US on H4 visa in 1999 and she got her H1b in 2001 and since then she is working for a big company with more than 50000 employees. She has not gone to India since july 2001.She is planning to visit india this year and at the same time she is planning to stamp her H1.
1.Anyone has any recent incidents with the above mentioned issues.
2.And also we saw the documents required for the process and they are asking previous experience letters but her's is a entry level position and she never worked in india and the company gave her training after hiring.we have no idea what to do in this situation. We can provided everything they are asking from present company including pictures, annual reports ...etc but not from previous company. Please advice what to do in this situation.
3.Is INS going to send her H1 papers to chennai including the company petition also.
Please answer the above questions.

Thx.

3. Did you request for consular notification? If not this itself is a reason not to go and try for visa stamp in India.

I would not recommend a H4 to h1 visa transferee to go and risk h1 stamping in India. My opinion.

thanks for the reply, but what is our option. We cannot go to canada.

How do I find out whether I requested to send papers to chennai consular. Please advice. If I requested then do you think we should go to chennai for stamping.

Thx

Same problem here

I am in the similar situation ,please let me know if you get any more information.

I am thinking to go to Mexico insted of going to India.

One thing is sure in these sites people always scarying other people.
I believe if we have all the required docs ,India is the best place to get it stamped in the worst case she can come back on h4 and change back to h1.

Thanks
Jaya

Thanks for the reply jaya,
Could you be more specifice about your situation. You were saying that you are planning to go to Mexico, but do you have visa to come back into US,I think valid I94 is not an option anymore. Please advice...

Thx

I do not know why people feel canada/mexico is safer than India for stamping . If you are refused a Visa or any delay is there , u cannot enter USA from any of these countries ..

In india , you are still at home as compared to these foreign countries ..

Tell me if I am missing something here

Hi,
Do not fell scared. Mine was a similar case. I came on H4 and got my H1 later. I worked here for a year before I went to India for stamping . I went to India Last year in Nov and got my H1 stamped there. The counselor took a long interview asking about my job, salary , qualifications etc , but finally gave the visa. There could be one issue though as I had 5 yrs of previous experience and all experience letters.

If you take any appraisal forms or if you can show some bonus etc that might help.

Thanks Shalini,
We have no idea what to do with previouse exp letters. My wife took training in a big training institute in india and helped them in their little projects and the present company where she is working now considered that as work exp and applied for H1.We have certificates for the training but not exp letters. No idea what to do.Is there anyone who got H1 visa stamp without previous exp.I know folks who did MS here had no problem

Thx.

And what do these statements mean?
3.Is INS going to send her H1 papers to chennai including the company petition also.
