Hi everyone,
My wife applied for H1 in last December and got approval (I-797 without I-94 attached because she was in INDIA at that time) in JAN'06, then she got married to me and came to USA on H4 in MAY'06, now she wants to trasfer to that approved H1, my questions are
1). Can she goto Bahamas/Mexico for that trasfer or does he have to goto INDIA only
2). If she can goto Bahamas, can she just go there or do we need to inform the Bahamas US consulate about her I-797 approval through another form called I-824. (Because on I-797 POE is Chennai)
3). If she goes to Bahamas for her H1 transfer and for some reason her H1 gets rejected, can she come back to USA on her valid H4(valid till DEC'08) or will that also be cancelled (I heard they will first cancel the previous visa then decide on the current).
Any help is greatly appreciated.
