H4 to H1 Transer

hi,

I have got my H4 stamped in the Jan 2009 which is valid till 2011. I plan to apply for my H1. Which will be the better option.

1. Filing H1 from India or
2. Filing H1 from US

Does this make any difference. What are the advantages and disadvantages in the above two options.

As of now i am in India and i plan to come to US in mid of April. One of the consultant whom i approached told that it is better to go to US before 31 March and Apply for H1 from there in US...so the chance for rejection will be less.

Can someone please help me regarding this issue.

hi...one more big problem now a days is that you need client's work order of you want to apply for H1B visa. So if you have job in hand from USA then only apply otherwise they might create a problem when you will coem at the port of entry in USA. They will ask for your client info and if you are planning to search for job after coming to USA then it is really tough. It is better you come to USA and then apply for VISA. Atleast you can come on H4 safely and once H1 is approved, you might look for job from SUA only...

Pls take somebody elses suggestion too. I am a nor mal person like you and trying for my wife's H1B visa. Even I am also inquirirng for the same.
