Hi,
I searched the faq to find some answer for my question but I could not find any.

I came here on H4 and I got my H1B approved with I94. And also I started working. I want to get my H1B stamped. Is it possible to get the H1B stamping in USA itself?

Some ppl are saying that I should go to some other country to get the stamping?

Please advise me.

I appreciate your help.
thanks
Suresh

To stamp the H1 in US itself (which is called revalidation), one must have the same visa in the passport and not expired for over a year. Hence, you do not qualify.

Stamping at the US embassy/consulate in Canada or Mexico has always been a safe route. But since 2002, if for any reason, one fails to get the visa stamped, he/she cannot return to the US with the valid I-94. There is a risk involved now. To minimize the risk of being stranded in a 3rd country, it is best to stamp it in your home country when you are there on a visit.

Good Luck!

I must agree with Upstae_NY about problems after Sept11th. I got my H4 converted to H1 one month prior to september 11th and I didn't have any problems at all. It was done in Ontario, Canada.
It went like a breeze. One thing is there if your H1 is rejected for any reason in Canada you can yet enter the country on your H4. So you should be able to enter the country without any problems.
I had no problems whatsoever.

I thought I heard, of late, that one can NO longer get the visas in a third country, be it canada or mexico! Plus, once you have an approved H-1B petition, it is considered quite safe to get the visa in the home country. It is unlike F-1s where random rejection is quite rampant.
