H4 to H1, PayStubs ??

Hi:

I am on H4 visa as a dependent and my husband is on H1 with a consulting firm. He is on bench since the last 3 months and he doesn`t have pay-stubs for the last 3 months. Now I have a job offer and I need to convert from H4 to H1 visa. So my employer is requesting documentation. Do I need to submit my husbands pay-stubs as part of the documentation ?. which he does not have.

Please let me know, if anyone had the same situation and how they dealt.

No need to submit paystubs of spouse.

You can submit without PayStubs for now but...

I ran across a similar situation for my wife. I had to respond to a RFE by submitting paystubs. So you may as well be prepared with some form of pay stubs, in your case it may be better to send what you have now rather than later.
