h4 to h1 ...now travel

Hi,
I'm in H4 visa status. I'm planning to do my H1 visa now but I will be going to India after applying....will there be any problems while returning??I will be returning back by the end of October.

And also..
Can anyone tell how many H1's are filed till now??? OR What are the chances of quota filling...can it be within 3 months by now..??

---NO, if you enter with H4 visa stamp then status will be H4 and you will get I-94 based on H4
I will be returning back by the end of October.
--------If You are on H4 status now and want to file Change of status from H4 to H1 and if change of status is filed and you go out of US while change of status is pending with USCIS it will be abandoned
And also..

---- last report by many lawyer was published 2 months back and it was around 17000
OR What are the chances of quota filling...can it be within 3 months by now..??

Thanks for the response....if I apply for the normal H1 visa now...and come back in 25 days ...any problems with that..???

----- still you will enter on H4 status and USCIS is not going to approve your H1 in 25 days. Apply H1b when you come back or apply H1 with premium processing it may get approved in 15-20 days then take the H1 approval, get H1 Visa stamp from Consulate and enter on H1 status
