H4 to H1 Is it in the regular H1 B cap

Any first time h1b whether it is coming from out side USA or from H4, F1, B1, B2, L1 , L2 etc all come under quotas.
Any how, this year 2008 quota is consumed already.

When you file for your H1 B from H4 does it still fall under the H1 B cap?

Continuing on this same lines......need clarification in following situation..
My wife is currently under H1. She intends to leave her job. So our immediate move would be she would come under my H4 (i am on H1). So can she take up another H1 later when she gets job and not worry about the quota issue?
