Hi experts,
I have applied change of status from H4 to H1 for my wife.When the application was given my i94 had a validity till June 16th 2007.
a)What are the chances that her H1 comes with an I94?.
I have my H1 got extended last week along with her H4 till 2009.
b)Will this change be considered while the H4 to H1 COS application is processed (As I had not notified USCIS about my H1 VISA extension)
My wife if planning to travel to India with me in July first week and will be returning to US on H4 status by August first week .We both have to get it stamped as my H1 VISA will be expiring in June 2007 and will have a I94 on her H4 which is different from the one that was sent to USCIS.
c)Will this have any impact on her H4 to H1 conversion ?.I have been told by somebody that if I am in US on H4 and H1-B is filed then I must not leave US till I get H1-B approval.
Please give me some advise on the above
