H4 to h1 and h1 to h4

I came to us on h4 and changed status to h1,i am going to Chennai for stamping h1.In case if they denied my h1 and issuie h4 visa.

To apply for fresh h1 should i applied in the h1 cap.

Not subject to the cap. There may be an issue only if the H-1 is revoked by CIS (not the same thing as visa denial by consulate).
