h4 to f1

Hi,

I am working on h1 visa and applied for GC last year and it is still in labor stage. My wife got admission in Phd and needs to change status from h4 to f1.
1) Did she has to go back to India to get f1 stamped?
2) Or can she apply for transfer within USA?
3) IS There chance that f1 can get rejected due to GC process.
4) if she gets the F1 can it affect the GC process?

I have a similar situation but with a different twist. I am on H1B trying to convert to F1. I have an admission for Ph.D. program from a very prestigious University, however, I filed for my GC, just one month back.

As I do more research, mayny eminent lawyers have advised me that my application for conversion to F1 will be refused (I have not yet applied), causing complications for my GC process also.

Reason - F1 is a non-immigrant visa and I have already shown immigration intention by filing for GC.

To take the matters to other extreme, even if I withdraw this application of my GC gets rejected, I can never get F1 Visa, having once shown immigration intent.

I have talked to several lawyers, they give the same opinion.

Please inform, if you filed the application for Visa conversion and then it was rejected or are you yet to apply?

I'm currently on H4, used to be on H1B before losing job. I have a master's degree from a prestigious US University but the job market is tight...I can't stand doing "nothing" so I was actually suggested that I should go back to school and get F1 in order to be able to study AND work during the time. My spouse's GC process should start in around 3 months, we're waiting right now for H-1B transfer approval before starting GC processing (spouse started new job 2 weeks ago)...

It's good to know about "immigration intent", that means I have to get university acceptance ASAP before applying for GC process.

Couldn't I just study under my H4? What would be the benefits of changing to F1 for study purposes besides being able to work? How soon would it be approved? Any comments will be greatly appreciated! Thanks.

Here is some new information.

If you have applied for GC and if you have EAD, even though final processes are not complete as yet, you can start studies.

US Uiversities will accept you on the basis of EAD, even if you don't have F1 or GC.

I am also on an H4 and have got admission in a school. My husbands GC is going on. I have also found out that going for an F1 visa is not advisable because of the dual intention. I am in the process of gathering more info.

One more question.
My H4 is expiring on 30SEP 2003 and I have to join the school by august. I will have filed for an visa extension along with my husband(H1B) but with the way extension is taking place, i wont have it by then. Will the school allow me to take admission based on the receipt notice for the extension of the visa.....pls suggest.
