H4 to F1..to get Opt

I am (Currently on H-4) leaving for India, but before I leave, I would like to apply for F1. My H-4 would be valid till 2006.

1. Can I come back in US on H4 If my F1 is approved before I returns to US.
2. I would be completing Master’s in Spring 2005. Would I be eligible for OPT?

Any advice would be greatly appreciated.

what do you mean "before you leave you would like to apply for F-1"? Do you mean you'd get I-20 form and apply for F-1 visa abroad? Or do you mean a change of status?

If you mean the change of status, you should be aware that by leaving the States while your application for change of status to F-1 is pending you forfeit the application and have to apply for an F-1 visa abroad.

1. You can come back on H4 visa and you will find yourself being in H4 status, but in order to start your F-1 student status you will have to start a change of status application and wait for several months until it is approved. If I were you I'd apply for F-1 visa abroad and enter on it.
2. If you have been a full-time student on F-1 status for a year, you are eligible for OPT. If you haven't been a full time student in F-1 status for a year, you are not eligible.
 
why don't you apply for F1 in India

If you are going to India.. why don't you apply for F1 in US Consulate in India.. It will be speedy and you will get F1 stampped on your passport too...
