H4 to F1 status change problem

Hi,

Two months back I have applied for change of my VISA status from H4 to F1, Very recently (i.e.two weeks back) my husband’s employer applied for our greencard labor.
Last week I received a letter from INS asking for evidence to go back to India after my studies. I am in kind of dilemma to proceed further with INS or not, bcz we already applied for labor which indirectly shows our intention to stay in US. I feel someone in this forum might have experienced the same situation. I am requesting for your valuable suggestion.

If you say I can proceed without any problem, I have one more request. INS is asking for conformed return ticket to INDIA to secure my departure from US. But Airline carriers are not ready to issue ticket for 2004. I am just wondering how can I handle this strange situation.

Reason to withdraw F1

You can consult a lawyer and reply to INS letter stating that "because you are unable to get confirmed airline ticket in 2004" you are withdrawing the application. It would help if you can ask some airlines to send you refusal in writing because of their company policy etc. etc. You can always study on H4.
