Hi,
My wife was on H4 in July 2007. She started MS from Sept 2007. We applied for COS to F1 which was approved by USCIS in October. She applied for internship opportunity and she has got CPT approval as well. Also my (husband) labor is still pending and won't be done until we come back.
Now, we want to travel to India in May 2008 and she has already completed more than half of the credits for her MS degree.
She is planning to get F1 stamped in India. Questions.
1. Is there any risk of getting F1 VISA rejected. (considering the strong case that she has already finished 2 semester and have internship as well)
2. In case her F1 is rejected, can she immediately come on existing H4 which is valid.
