Hypothesis is

Your hunsband is in US with H1 , with immigration indent.

Wife is going to US with F1 visa with no immigration intention.

How you are going to convince the great Chennai Counsel?

good luck

Alternate

Change to F1 with in US do not travel. Once study over get H1 travel.

Thank you very much for your reply... But I really have to go to India, it is urgent, some family matter... Can I go to Canada and get my visa stamped??? Is getting stamped in Canada less riskier than getting stamped in India???? Plz advice, what precautions should I take???

Is stamping in Canada less riskier than stamping in India???

Waiting for your response GURU, thanks, I really appreciate this!!!

Only problem is, if Counsel in Canada ask you to go to your home country for stamping you should prepared for that too.

If you are lucky you may get your F1 stamping.

Actually, stamping in Canada can be more risky than in India. Also, if you get denied in Canada and asked to apply in India, you cannot return to the US. You will have to arrange to fly to India directly from Canada.

if i was in ur place i wuld go to canada.
actually i m planning to do tht in august.
cuz either way u have to go to india, but if u get it stamped in canada first u dnt have to go thru the hastle in india.

my advisor and lawyer told me to go to canada and they will stamp it, if not i have to go to india, so i m taking this chance knowing tht if denied i have to go to india but i wuld know tht only after i go to canada, hence canada.

he also told me tht its too much hastle to go to my home country and get it stamped, cuz they have the statistics and they know most of us wont return 99.9% wont return, so they will try and hold u back.
my cousins wife had gone to india she was on h4, first on f-1 and she had to face lots of issues when she went to india.

talking from my personal experience and knowledge, i wuld recomend u to give Canada a try.
