H4 to F1 in USA

Hi,

I have applied for MS program for fall 05 and currently I am in USA on H4 visa. I am going to India in June 2005 and I will be back before july 10, 2005.
I have got acceptance from 1-2 graduate schools and they will be sending me I-20 on my USA address.

I want to know following :

Can I apply for change of status from H4 to F1 when I will be back from India in July 2005 or that will be too late as graduate schools will start in 2nd or 3rd week of August?

Can I apply for F1 while in India and come to USA on F1 in July 2005 even though graduate schools won't be starting that time? I mean ...will F1 allow me to enter so early in USA?

I heard change of staus from H4 to F1 is sometimes risky in your home country...is it true?

please advise me on this.

Cathy,
There are some pros and cons in both the ways of getting the F1.... If you will get that in India it will be quick and you will get the stamp as well on your passport....
But if you will get it converted from here... How much time it will take is hard to predict and then again it won;t be tsamped on your Passport.. If you are not getting any TA or RA i mean if you are not getting any money from the University .. u can still study on H4....

Thank you ALL for your last feed back which was of course very helpful to proceed further, now I have one more question related to the same topic.

Now is that my wife already joined college and doing her Masters since early 2004 on H4, and due to mutual understanding with professor she managed to do her part time but unfortunately the department is unable to pay her even if they can since she is on H4. She will be into her final semester in coming August 2005.

Now my question is:

1. Can she apply for her visa conversion from H4 to F1? by doing so she will have an opportunity to take the advantage of assistantship and also apply for OPT. (fyi – College is ready to provide her with I-20 and all other reference letters and supporting documents that are required during the conversion)

2. If the answer is "Yes" for above question then does she have to go back to India for F1 stamping or she can visit Mexico or Canada?

3. For Some reason if her F1 is rejected then will the actual H4 still be active?

4. Before I got married I had to change my employer from company “A” to company “B” and got my H1 Visa stamped based on company “B”, got married and she came back on “H4” in reference with my new company “B”. She joined her college when I was on company “B” (h4). Now I had to join another project and once again I had to change my employer to company “C” and I have new H1 and H4 papers from new company “C”, so does she have to take company “B” h4 also during her visit to consulate?

Any advice on the request is greatly appreciated!!

No need to get F1 stamped if you are not going out of country....

It is very goos that your wife will get TA/RA what ever is that..It is true that she cannot get any money while on H4 ... what we did in my wife's case was that we applied here for her F1 while she was on H4.. she got approval.. which (F1) was never stamped on her passport.... last year when I filed for I485 we also filed for her AP and EAD... I don't know where you stand on that front....
but if you are not travelling outside then thereis no need for getting it stamped...
