H4 to F1 Conversion - Advice Needed

Hi All,

I am planning to get my visa converted from H4 to F1. My husband's employer is under the process of his GC.

1) Is it OK for his GC processing and me converting into H4 to F1?

2)At what stage of GC can I be included in the processing??

3)WIll I have to convert back from F1 to H4 to be included in GC processing?

4)While I apply for F1, It seems like I have to provide proof of return to my home country after I colmplete my degree - At that time do I have to say in U.S Consoluate that I might be become an depent of my husband during his GC proceesing or should I not specify that during my F1 conversion interview. Will that be a problem, in between of my F1 when my husband's GC processing do I have to get converted into H4 to include myself in th GC?

5)Do I have to goto India(home country) to get stamping? If my F-1 got rejected, can I enter into Us as H4 again?

We are in same situation. Has anyone succeeded in changing visa from a valid H4 Visa (till Jan 05) to a F1 Visa in Canada or outside US?
If F1 gets denied can one come back on the previous H4 Visa?
Any comments will be much appreciated.

Hi,

When I had a change of status (F2 to F1), I enquired about the same thing. I was told (officially) that if my F1 visa is denied (be it in India or Canada), I cannot re-enter on my old F2.

However, one can always apply for a new F2/H4 if F1 is denied outside USA.
