Hi Guys,

I am on an H4 visa and completing 6 yrs in Aug 2006 stayed out of US for 14 months (total - off and on)

I have some questions. Would really appreciate if anyone could answer them.

1. can i apply for student's visa at this point of time and would it be approved?

2. Will i be able to work even on F1 visa?

3. How long would F1 visa be valid after I get it(If I can get it) ?

4. whats the OPT status and how long it would be valid in my case?

5. Will i have to go back to india after F1 visa gets over?

6. Will i be able to get h1 after OPT or F1?(if yes then
for how many years)(if no then what needs to be done
to get h1).

Would appreciate any help that I can get...

Thanks !

1. Yes,
2. No.
3. No one knows as it depends on your I20.
4. 12 months maximum.
5. If you could change your status in the US, no need to go back, however, if you tell USCIS or consulate you will stay in the US after F1 is over, your F1 will be denied.
6. Yes. 6 years minus your time spent with H4.
