H4 to a new H1B

Hi,
I am currently on h4 my 6 years are expiring june 2006.
If i go to india in july will be eligible to apply for a fresh h1b in apr 2007
can i come back in june 2007 on h4 and then wait for my h1 to come
or if i am not eligible in june 2007 can i come back on h4 and then apply in 2008

You must stay atleast one complete year outside US to get your new H1.

I have one last query
I have decide to go back to india in august 2006
Can i apply for my h1b in april 2007 so that i can enter United states in september 2007 when the h1 opens
If my h1 gets rejected due to some reason can i come back to united states on H4 after completing a year using my husbands existing h1 and then apply for h1 in 2008 will my clock be reset by my staying out of united states for 1 year.
