I was working for Company A and I applied H1B for Company B. What happened was after applying for Company B H1, I got married and I got my wife on Company A since I was working for them at that time and i did not join Company B.

Now I resigned Company A and joined Company B on my new H1b. Do I need to again apply for H4 status extension for her?

Mine and Her I-94 expires in March 2003.

I wanted to send for stamping to st. Louis in January 2003. Will they consider my new H1B to stamp visa for her ?

I think you should follow someof our other threads regarding this issue..
Anyway ..When did you changed the new company
and what are the dates
and when you apply for the Company B did you applied your wife extension >?? that means did you or your lawer applied form I-597 (exntesion of visa )..

------ if I-94 expired in March 2003 then you both are out of status and staying illegaly in US. I hope your I-94 is valid till March 2004

You are with Company A or company B, you both need valid I-94 to stay in US. If you joined company B with H1 transfer then you have also to extend your wife H4 from BCIS before her I-94 expires. Many Transfer H1 or extend H1 and forget to extend H4 status that should be filed with H1 transfer or before the I-94 of H4 holder expiry date. one need to file H4 extension with USCIS with form I-539 and pay the BCIS fees $140

When I applied for H1B transfer for Company B.. i was single. So I did not apply anything for my wife. Now that I joined the company.. I thought my H1 would be enough lookslike i need to apply for her too.

Since her current I-94 expires in Mar 2004.. i will apply immediately.

1) Will it be called "H4 extension" or "H4 extension/transfer" ?

2) Can I use same form I-539 for both the purposes ?

3) Can I do it myself or go thru the company attorney?

4) What are the documents necessary for this ?

-----Apply her H4 extension ASAP it takes 3-5 months to get approved, but once she files H4 extension and gets H4 extension filing receipt no problem

----- Form I-539 is used for H4 extension for H1 extension employer gets LCA and has to fill up form I-129 and other stuff, your wife H4 extension needs form I-539

She has to fill up form I-539 correctly and sign the form, pay USCIS fees $140, copy of her current I-94 (front and back), copy of her passport pages, copy of marriage certificate, your employer letter that state you are working with them on H1b status and request to extend H4 of your spouse name XYZ, copy of your 3-4 recent pay stubs, copy of your latest H1 approval notice, copy of your I-94 (front and back) and attach the cover letter to your service center

Thanks again for your replies. Looks like in California Center it is taking 3 to 4 months of time for I-539 applications. Her current I-94 expires in March 2004 but I am not sure whether i will be able to get it by that time.

Will it be enough if I just apply and get the receipt like h1b transfer or it has to be approved by March 2004 ?

if it has to be approved i am planning to go with Premium processing.

------------- Just file for her H4 extension with form I-539, she will get filing reciept in 10-15 days, she will be OK with filing reciept
