Hi Guys,

I had applied for H4 stamping for my wife and son. I am in US with a H1 visa. The US consulate, Chennai had sent me a query asking for Marriage certificate (instead of which I had kept a affidavit). So I took off from my work went to India, registered my marriage, gave the document to US consulate (drop box), came back to work. Now they have asked for further documents.

1 Recent letter of offer from the U S company (Original)
2 Interior and exterior Photos of the principle at work
3 Interior and exterior photos of the principle at home.
4 Originals of dependent and principal s phone statements for the last
six months
5 Principles certified or notarized state and federal tax returns for
the last three years
6 original W-2 forms and pay stubs for every year worked in the U S'
7 Copy of deed,mortgage or rental agreement for residential property
in U S

I have been working for the past 6 months, so I do not have federal tax returns for the past 3 years.
I have been staying with my friends so I do not have a rental aggreement.

Any advice regarding this would be of much of help.

I had to face the same problem when I had gone to India with my family and had to get H1-b for self and H4 for my spouse and kid at New Delhi embassy. In my case we all did not have a visa stamp in our passports, so they sent us a green paper saying they intent to deny us visa due to lack of documentation and advised us to attend a personal interview with most of the documents you said except no phone statements, W-2's of all the employees, reference letters from past two employers, bank statement where the salary is depoisted.

We attended the interview and were just asked to show the tax return for 3 years. Asked some difference between H1 B salary and salary reported to IRS, answered it and then she approved the visa.

I think you can do no 1.,2.,3.,4.,6.(Pay Stub part).

For 5.,7. write a true reason. Bottom line if you are in status on your H1-B consulate will approve H4 after providing them the required documents or reson why you cannot provide them. they want to make sure there is no fraud involved.

Will the Consulate accept if say, I have been staying with friends and going take a rental only after my family come to US for point No 7. Will this cause any issue?. Is this reply sufficient.

I am going to give my phone statement. In case of dependents phone statement, they are staying with their parents, so I cannot provide that. Or I can provide their parents phone statement.
 
KCS,

See anyhow when your family comes U have to rent/buy a appartment/home. So it is better you start looking for them and have your moving date close to ur family comming here in US. I think when you pay the deposit they provide you with the lease papers. This way U can show the consulate that you are willing to rent a place.
