My spouse had to travel to our country as there was a sudden death in his family... I had to stay in the US as our baby doesn't have a passport. I am the H1B. He's got the notice of action approving his H4 from the INS. Additionally he has a copy of my visa and passport, all the H1B paperwork, marriage certificate,
birth certificate of our son (in case they ask). My question is: Am I required to go with him to the embassy to get his H4 visa stamped??? Is there any other document he may need...? I need some guidance so that I can plan my trip if I must go.... Thank you for your time!

As far as i can remember, the consulate would ask for your I-94, an employment letter from your employer, and if possible, give him a copy of at least 2 or 3 months paystubs. these are just proof that you as the H1B is still working legally and is employed by the same company. You don't have to go with him...The other papers, like your marriage certificate and such, yes, he will still need it. make sure he brings the original copies if possible.

I believe you don't need to travel for your spouse to get his H4 visa. Follow this link:

that provides the documentation necessary to get a H4 visa from the Chennai consulate:

"Applicants for H-4 visas should submit the following in addition to the documents listed above:
>their marriage registration certificate
>wedding photographs may be required in some cases
>and a photocopy or the original passport of their spouse and H-1B visa. The copy should be a GOOD quality copy and the photo must clearly identifiable.
>You will also need a letter from confirming the continued employment of your spouse."

As indicated in another response, it wouldn't hurt to keep handy the employer's letter confirming employment, last three pay stubs
and probably the most recent bank statement. It would benefit if he has the original H4 approval notice. I am not aware if there is a risk assciated with sending the same via a courier service.

I am confused about the child's birth certificate that you mentioned. I believe it may not add any value to the application for the visa.
