H4 - Spouse issue

Hello everybody.
I have a question regarding my case.

I signed the I539 form to extend my visa status while my H4 was still valid.
Few days ago I received the I-797C notice that my case is being reviewed BUT their received date of my application is over 1 month AFTER my visa expired.
My documents were signed by my spouses employer and they were responsible for filling and processing my documents which I payed them for.
Due to some circumstances that I can not reveal at this point I have limited access to all the documents.

From what I understand my case means that I am already out of status.
Can somebody please clarify my question and tell me what are my options?

---------------------Not a problem if form I-539 reached USCIS before your I-94 got expired. I dont know what date USCIS got papers and till what date was your I-94 valid.. May be lawyer sent the documents late to USCIS. RD is the date when USCIS mail room receives your petition and they stamp the receipt date.

------------------If spouse is on H1 status and your form I-539 reached USCIS Before the date of I-94 expiry date then you are on valid status as you filed H4 extension on time(before I-94 exiry date)and your H4 EXT is pending.
