H4 RFE/ Pending --- Can we apply for H1 or J1?

My wife got an RFE on her first H4 renewal in the US. RFE asks us to submit all the previous I-797 documents.

My wife had got her H4 first time in Chennai for the first time 2 years a go and this was the first extension in the US. I do not have any I-797 issued for her. My company lawyer has replied the RFE on March 14 and website says they have recieved the same on 17.

Questions:

1. Does anyone has an idea how long does it take for the RFE case to be solved?. (Note My H1 is already approved through normal process)

2. My wife has got a offer for Medical Residency starting July 1. 2004. Can she file for H1 or J1 while her H4 is pending?. The reason I am asking this question is, her Hospital has given her the deadline of July 1 to join the program

1. Usually the turnaround time after a RFE is less than 30 days.
2. If it is July 1, then h1 is ruled out. You can Apply for H4 to J1 change only after receiving the H4 approval.

1. H4 got approved after the RFE was replied. It took close to 35- 40 day range.
2. Why would you say that H1 ruled out for July 2004?.. The hospital has confirmed that they qualify as they are non- profit org. Is there any information, I should be aware of?.
