I am currently on H1 and entered into my 7th year of stay in USA. My I-140 is cleared and got 3 years extension for me. I got my kids transferred on to My H1 (Earlier they were on my husband\'s H1) so that they can get 3 years extension along with me. Now My husband\'s I-140 also got cleared but his 3years extension is yet to be approved. I am planning to go to India this summer along with kids, but worried regarding revalidation. Can I go for stamping first and then get my children there later in a week (once mine is done). My worry is, if for some reason, we don\'t get the visa stamped, Kids will get struck in India and they will have problem with their studies. So, if I have any issue with my visa stamping, they can stay in US and continue their studies. Please advise me.

Your thoughtful precaution is highly appreciated. Couple of extra doller spent on travel may be reasonable to avoid your worries. You can do the way you wanted it in the embassy. Studies are important, yo know that. Some case people were held for 2 years just for name /security check.

Interesting thing to share.

One of my friend a MD doctor 8th year H1 extn afraid of going to Chennai for stamping, but due to emergency he has to go and revalidate his visa. Since his hospital is very famous one there was no problem in visa stamping but for his son a 8th grader, the counsel was asking the boy - Where do you study? Public School or private school. The boy answered public.
The counsel mad at him and raised voice "how can you study in the public school?" / He consulted with other counsel seriously (as if he found a reason to reject the visa stamping). The other counsel explained to him that these H1 are paying thier Federal and state taxes so they are eligible to study in the public school. Finally they got their visa stamped.
