H4 Rejected based on Student. Plese Help

Dear Immigration Experts,

My wife is on H-4 visa and recently our visas expired so we ended up at New Delhi consulate to re-validate the H-1 and H-4 visa.

Since my wife is student on H-4 visa in US she wrote her occupation as student and the consular rejected both of our visas saying that she needs F-1 and once she leaves US while on H-4, can only enter US on F-1 NOT on H-4.

I cannot find any information on internet to prove that H-4 have right to study in US.

Please help us we are in Delhi and no one is helping us.

This is really unfortunate..U shud contact the international student advisor of the school she is studying and they shud provide the documents that one can study on H4 full time..though without funding..

H4 can sure do study full time or part time. As opposed to F-1, H4 has the liberty to take as many courses as he/she wants. But F-1 needs to be a FULL TIME student.

I am sure US embassy in India would know this. May be they thought that you are working there on H4 visa, which is not allowed. Try to convince them that you don't work just attend classes.

Definately get in touch with wife's internal student co-ordinator.
