H4 Refusal 212(a)(6)(C)(i)

Hi Folks,

I got my H4 rejected under section 212(a)(6)(C)(i) based on my previous H1B rejection 221(g), Do U guy's have ever come across such situation, if so could U plz advise me what would be the best possible way to come out of this situation , I mean ...."waiver of permanent ineligibility", your inputs in this regard is appreciable, further you can send me ur valuable opinions/advises to my ID : "itsreedhar@yahoo.com" Thanks & Regards : Sreedhar

What reasons were marked in the 212 (g) list.

What makes you h4 rejection. H1 and H4 is two different issues. If you post more info , it is possible to give good solutions.

Hi Many thanks for your reply, here with I am furnishing details for my H4(depandant refusal) I got my H1B rejected in May 15th 2001 based on the grounds of FAKE experience, later on recetly I appeaed for H4, further it was also bluntly rejected by consular officer based on my peviouls h1b rejection, further he didn't even give me a chance to speak.

It would b highly appreciable if you could help me out on how I can go for 'waiver of perman ineligibility"...

212(a)(6)(c)(i) is I believe misrepresentation and the only waiver that is available is if you are a spouse of a us citizen. No other waiver is available. This is very serious issue. If your spouse is in US they should talk to an experienced attorney immediately. They are supposed to use this provision sparingly and that is why they refused you as 212 g previously based on fake employment letter.
