H4 Qn.. Does validity of H1 matter?

Folks,

Is there any restriction on the H1 validity when applying for H4 for the spouse.

My H1 will expire in March '04 and I have already filed for I-485. Planning to get married and apply for Spouse's H4 in Feb'04. Will the short H1 validity in any way effect H4 approval ?

Your spouse will only get H4 till your H1 approval validity and she should enter few days before H4 Visa expire. You the primary H1holder should not use EAD so that she can get H4 visa stamp
 
Thanks Ginnu for your response.. yeah I do understand that I have to maintain H1 status through out and also that her validity will be only till my H1 expiry.. But do U think that is a cause enough for the consulate to not approve the H4??

I don't see any problem in this.
Got Married in Dec00 w/ H1 expiring Feb1, 01
Applied for H4 and was issued till Feb1,01...
No Problems at POE either
