H4 problem?

Hello, I have completed 6 years on my H1 and am planning to return on a new H1 along with my family after completing a year outside US. I heard that for my wife to get her H4 I should have a valid visa on my passport which I do not have since I'm applying for one myself. Is this a problem or am I worrying too much. My first son was born in the US and my second son was born in India during the past year. Please advise.

Thank you

You have to get a H1 visa stamp to enter US for the new H1 tenure. When you get that stamp you can get the H4s for all your dependents.

Let me understand your situation correctly. You were in the US for 6 years, then you left for your home country and have been out of US for 1 year. Now you have a new H1 approval and want to come back to US, is that correct ?

If that is the case then you will have to get H1 stamped on your passport before you come to the US, because without visa stamp how on earth do you think you will come to the US??

When you go for visa stamping for yourself, you can take your dependents along with you and they will get the stamping at the same time as you do. You do not have to have a visa stamped on your passport before, all of you can go together and get it stamped together.

Hope this answers your question.

That is exactly the answer that I was looking for. Thank you very much. Sorry for being a bit vague in my question.

Thank you
