Just make sure that you assure the POE officer that you (your spouse's employer) will apply for the H1 and h4 extension as soon as you enter US if it has not been already applied for .
If an extension is pending carry copies of the extension application. or receipt.

I came back to US just a month before my Visa expired and office at POE told me not to leave the country without applying for visa renewal. I said OK. Thats it.
