H4 'Last Name' change question.

Hi - Me and my wife got married when we were on H1 here in US, she then changed her status to H4 (didn' change the last name). We both are going to Chennai, India and have to get stamping on our passtports (H1 extension for me and H4 status change for her).

1. Does she need to change her last name before submitting H4 stamping application thru TTS in chennai? If yes, how long does it take change the last name?

2. We will be applying during 2nd week of Jan'03, do you have any advice that should/can be followed to prevent any complications.

3. How long does it usually take to get the stamped pasport back?

1. Name change is not required. Name change takes 2-3 days at the passport office . Not sure. However the Indian consulate in US can do it in 2 - 3 days in mail . See http://www.indiacgny.org/

2. Getting H4 stamp at the consulate (after being on H1) should not be a problem but there might be a risk, i.e. they might ask why she is not working after marriage and might deny based on immigrant intent (although H holders are allowed to have immigration intent, they consider H1 to H4 as covert intent!). Chances of that are very slim though.

Now, you got me little worried.....We are planning apply at the same time for stamping, what if they deny her H4? what are my options. Thanks.
 
Risk is low since you will be applying together. No other options available if denied.
