H4 Issue - Please Advise

Hi,


My 2nd H1 IS getting over on dec 25 , 2002 . (not stamped on my passport) In the time being i had applied for a h1 transfer(THIRD). I have recieved the LIN number / receipt. Unfortunately i had got a query and i have submitted the required documents to INS. They say that it will take min 2-3 months for the approval.

My wife who is on a H4 had earlier gone to India (TWO YEARS BACK) and got her visa stamped (H4) in the passport (MY SECOND H1) which is valid till dec 25 , 2002. She has again gone to india about three months back Now she is planning to come back a month before the visa expiration.


1. I would like to know if there would be any problem at the port
of entry. Or any specific questions they would ask her ?
2. what documents should i send from here so that there is no
issue at port of entry.

Generally H4 holders are not asked any serious questions about spouse's employment. If asked she can always say that application for H4 extension will be made after coming into US.

have you applied for her new H4 (based on ur 3rd H1)? And have u already started working for new company?

My case is similar and I'm very paranoid from INS' responce. They said that H4 ppl needs to get new stamp on their passport b4 coming to USA. US consulate's ppl in India said same thing.. Only the lawyers' in USA are saying that there wont be any problem reentering USA as long as H4 visa holder has valid visa at the time of entry.
