H4 in Progress can we go for H1

hi guyz,

I'm already on H1 in US. My wife is in the same company (in india) as me and her H4 Visa appointment date is on 11th July.

Now there is an opportunity for processing an H1.

My manager says that it can't be done as her H4 processing is in progress.

Is there a constraint that if a person's H4 is in progress he/she can't go for H1.

Please help me out as on basis of this i'll have discussion with my manager.
 
What do u mean by "H4 processing is in progress". You are getting H4 visa in India. SO your company is doing nothing except giving you emploment letter.

Now the question: Is same appointment for H4 could be converted for getting H1 ? This question could be answered by US consulate or agency related.
