H4 / I94 Overstay

H4 Overstay Issue

Hi All,

My H1 got expired in may 20 ,2003 and at the same time
my wife and daughter H4 /I94 got expired .
But I got my H1/I94 extension for another company and back to
status . But I forgot file dependants H4 / I94 extension along with mine and they overstayed 3+ months now .
We applied for their extension through a lawyer after 100 days
of overstay .

Does anybody come across these type of situation ?

If visa etension got rejected they have to get it from
Chennai India , Any Idea about the chances of getting
from there?

Your underlying valid H1 will most probably save them. If they get the new H4 approval with I94 than I would advise to get the h4 stamp from Dept of State (St.Louis) rather than risking it in chennai consulate. Even if they get h4 without I94, try to get the I94 first (by going to the nearest port of entry or local BCIS office), try with DOS before attempting at chennai.
