I have a problem which I hope someone among you can guide me in the proper direction.
I have been here on H1(the worst thing to be in the united states) since june 2000. The company I was working closed down in the end of 2001. I had a lean period during 2002 and 2003 in which my w2/1099 does not reflect the wages in my LCA. Its a lot lot less than what I was supposed to recieve. this was because I had some odd jobs and things like that. But I had my status thro another employer who filed my H1 in the month of july of 2002. In the year of 2004 things have brightened up and I have a good salary and so on. Now, in month of may 2004 I got married in india, When my wife went to get her H4 stamped(chennai consulate), they refused to stamp her the first time because she didnt have w2's of all the years. Next time when she went in(the next week) with all the w2/1099's and 1040's of all the years and the pay slips of all months in this year, they refused to stamp her visa again telling that the w2 for the year 2002 and 2003 doesnt show much and that I may not be able to support her and things like that. They didnt care about the salary slips of this year at all. I had my company's VP also write a letter telling that the company had taken care of my rent and insurance and things like that. But I guess he didnt care about that and went on harping that my 2002 1099 was very low and I must have been jobless and things like that. I'm in a literal bind now and dont know what to do. I dont have any hope that my wife's gonna get her visa stamped thro the H4 category. The consulate have sent and RFE asking for the I797, I129 and LCA.
As for my status now here , I have got my EAD and my I140 is approved. My I485 is pending. what can I do to get my wife here as soon as possible. What are my options?
I would be really grateful for any help provided or any suggestions of tips. Please let me know of what I can do .
