H4 ->H1B-> mandatory travel to india..

hello,

i came on H4 visa and applied for H1B IN MAY 2006. my H1b has been approved recently.

i need to go to india in Nov. i want to start my employement probably in January. i have a H4 visa stamped in my passport till Feb 2008.

now my question is..

1) IF I ENTER THE USA WITH H4 VISA STAMP, WHAT DO I NEED TO DO IN USA TO MAINTAIN H1B STATUS TO DO WORK... LIKE DO I NEED TO FILE ANY AMMENDEMENT TO GET MY H1B STATUS..

incase if ammendement need to be filed, how long does it take.. what are the risks involved..

2) WHAT CAN I DO IN USA TO GET MY H1B STATUS AS IAM ENTERING THE USA WITH H4 VISA?

DO I NEED TO FILE ANY AMMENDEMNTS OR ANY PAPER WORK TO RETAIN H1B
STATUS?

what will be the options if i enter the usa with h4 visa..???

It seems your H4 to H1 was filed COS from H4 to H1 and you got I-94 attached with your H1 approval notice and your H1 start date may be october 1, if that is true then your status will be H1 after october 1.

if enter US on H4 then employer has to file COS from H4 to H1 again with USCIS.

** why not to get H1 stamping when you go out and then enter on H1 status if you want to work and employer has job and can pay you.
