H4, H1B has same I-94 number

My wife was on H4 status, and she converted her visa to H1B last year (Sept 2004) - she is currently employed under H1B. When she was on H4 she had a SSN card (not valid for work), after she got her H1B we really didn't pursue to change her SSN (valid for work with INS authorization). She basically started working right after he obtained H1B status. Recently she went to SSA office to change her SS card, they checked the record using her H1B I-94 number , but could not access her record. They said INS might block some access to their records.When she came home yesterday, i checked her current I-94 (with H1B) number is exactly the same as her previous I-94 number when she was H4.

Question is, Is it possible that I-94 number can be the same - and her INS record should still indicate her current status is H1B ? Is there any impact on her not changing her SS card so long ?

Can anybody give us any clear answer to the above concerns that we have ?

If she did change of status, the number on new I94 should match the one on old I94. If it does not match, then it's a problem :)
 
Are you sure ? Because recently my friend's wife had the similar issue (adjustment of status, and same I94 H4->H1), except that she never had any SS card. She came to U.S. with H4, and then changes her status - when she went to SSA office, SSA officer puched her new I-94 number, and got her status as H4. They denied to issue new SSN card. My friend and his wife went to INS office to talk to INS officer - the officer agreed that that was a mistake from INS part, and he fixed the problem, and issued a new I-94 number for her. And then they again visited SSA office - they issued new SSN card (valid for work with INS authorization.

Can you please reply my question with SSN (not valid for work?) - now we are pursuing to change this card after a year she started working with H1B.

You are right - GotPR?, I checked my I94 while I was on F1 is actually the same I94 that I got after adjustment of staus to H1B. I am clear about it. Perhaps INS officer misled my friend about his wife's case (which is possible).

The question still remains about SSA people who could not access my wife's record while she was attemting to change her SSN Card (Not valid for work) to new SSN card (Valid for work with INS authorization). SSA issued a letter to her that says it might take about 4 weeks to verify her status from INS. Do you think it is usual for them to not have access to INS record ? Is it worthwhile to wait until 4 weeks to get their reply ? Are we in the right track ?

Yes. It is perfectly normal for the SSA not to have record of the change of your wife's status to H1B.

I think this sometimes happens, when you change your status from $ to H1B, after coming to USA.

The same thing happened to me, when I changed my status from H4 to H1B.
The SSA office told me that they had no record of my I-94 number in their database and that they need to sent an enquiry to INS and only after confirmation of my change of status, that they could issue me an SSN.

They said it would take 3-4 weeks.
I was also very worried at the time.

But there were absolutely no complications. Their enquiry came out positive and I was issued my SSN within 3 weeks.

Thus I feel there is actually no reason to be worried.

Their enquiry will show that your wife's status has been changed to H1B and that there is a valid I94(with the same I-94 number as on the H4 I-94).

So, don't worry! Your wife will get her SSN in a few weeks.
