H4-H1 visa

Hello,

I'm on a H4 visa. I am getting a H1B visa done through a consultant who'll then market me. I just wanted to know if there'll be any issues if I dont get a job within few months of getting my H1. Also when I go down to India for my H1 visa stamping and suppose the consulate rejects my visa can I come back to US on my existing H4 visa.

Any kind of advice is appreciated.

It wont be a problem as long as you have a W2 at the end of the year to file taxes. For any H1B holder paystubs are very imp but you should be fine as long as the time to find a project is not too long.

--- may be, becase you are in US and you are changing from H4 to H1 and supposed to work with employer and he needs to pay you minimum wages as written on LCA, if he does NOT pay you then you may face problems when you go to India to get your H1 stamping in future. if the employer has no job and cant pay why he filed H1???

----- you will not be on H$ visa status you will be on H1, if you have H4 visa stamped and valid when you come back you can enter on H4 status if your spouse is still on H1 status at that time.
For more info ask the lawyer who filed H4 to H1 and your employer who filed H1 but has no job or unable to pay
