H4-H1 stamping. Which Consulate in India to choose ?

hi,

My wife entered US on a H4. She is working with a valid I-797 now. She needs to get her H1 visa stamped on the passport. Chennai Consulate has a 6 month wait time. New Delhi and Kolkatta are much better.

Can She go for the Visa stamping at New Delhi or Kolkatta ?

I heard somewhere that if you already have a visa and are working in the US, any consulate should be fine and you don't really fall into the Chennai Consulate's area.

Can some one clear this confusion ?

Note: Indian citizens resident in the USA and applying for a visa( restamping for H1, H4, L1, L2 , F1,F2 etc) to replace an expiring visa can request an appointment at any of the four US consulates in India. This facility is provided by VFS under emergancy appointment.

Looks like it is doable.

Hi

your spouse becomes eligible for applying with any of the 4 consulates in Indian only if she has relevant paper work to prove that she is a returning worker. Kolkatta is good to apply coz you have interview dates available even in May 2006.

for starters how about appointment letter, pay stubs, W-2s of all years worked.

If asked more client letter, project details, photos etc...
 
Sounds good. My main concern is if we decide to go for visa when she is inbetween projects.

I know what you mean, and most of us face the same problem, if we go in between projects for stamping there is always a risk they might ask for client letter etc... but there is nothing much we can do other than try to go to India when you have project.

It's very sad, because people who have been following rules and getting paid in-between projects are being affected because of this situation. If you are not getting paid in between projects don't take risk of leaving the country.
